A.F.FERGUSON's tax opinion on Wealth statements of Nawaz Sharif & Maryam Nawaz
Posted By: Khaaliq on 08-11-2016 | 02:54:02Category: Political Videos, NewsAFF's tax advise is attached. Tax opinion is entirely different from statutory audit opinion. Media is misleading by using the term "International Auditors". A.F.Ferguson & Co is a Pakistani Firm and a member of PricewaterhouseCoopers Network which operates in around 148 countries where each Firm is independent legal entity.
A.F.FERGUSON & CO is auditor of Shaukat Khanum Cancer Hospital. This particular firm was also operating in AFGHANISTAN, where they failed to report on 900 Million USD fraud in Afghanistan's KABUL BANK, which was reported in the bank's internal auditor's report. Eventually, they had to get forceful resignation of their Partner to save themselves.
A.F.FERGUSON's tax opinion here is only advising Mr. Syed Ajmal Sabtain (Manager Accounts and Tax Affairs) of Sharif Group of Companies.
Ferguson is beating about the bush on the line added in Nawaz Sharif's Return in 2011-12 (Assets held in the name of spouse, minor children and other dependants) by saying that due to lack of any other column Nawaz Sharif was compelled to do so. Had he not done so return won't have reconciled.
Can I deduce that if in 2016's wealth statement I am compelled to write something in some column today due to lack of comprehensiveness of the tax wealth statement and such deficiency is later supplied in 2018-19's wealth statement column, my act would be justified?
Please also read point 16 which forms "integral part" of the tax opinion, where AFF is saying that 16.3 "Tax advice is matter of interpretation of law" & "we are not certain that opinion expressed would be accepted by tax authorities".
You know chain of command Commissioner, Commissioner (Appeals), Income Tax Appellate Tribunal, High Court, Supreme Court and now in Panama case, Supreme court's larger bench headed by Chief Justice. AFF is disclaiming that they are not sure that it would stay even before Income tax officer. AFF did not say that you don't need this opinion now, since the Audit selections for 2011-12 are now over and your return is accepted as good.
Note: The snapshots of opinion were released by PMLN's twitter account.
